Deferred Prosecution Agreements (DPAs)
  • The Future of Corporate Liability in Europe

Objective

This online seminar will explore negotiated structured settlement frameworks to deal with corporations accused of criminal wrongdoings, such as acts of corruption or money laundering.

These agreements allow for the deferral of charges for a set period, as long as the corporation subject to the charges complies with certain conditions specified in the agreement.

Deferred Prosecution Agreements (DPA) and related instruments (such as NonProsecution Agreements) are a key  component of criminal justice in the US and might shortly become a cornerstone of compliance in Europe. By way of example, DPAs have been recently put in place in France and the United Kingdom, although they remain relatively unknown and deserve further consideration by law makers and legal practitioners.

The event will delve into the evolving landscape of EU criminal justice, focusing on the role of DPAs in Europe and similar tools that offer companies a path to avoid prosecution in exchange for cooperation and reforms. The legal and ethical implications of these agreements will also be examined.
