Objective
This conference will analyse the gaps in EU copyright legislation in the face of emerging techniques that allow for the digital "dematerialisation" of content. Besides considering the legal challenges and presenting new EU initiatives in the field of copyright law, the conference will also provide copyright practitioners with an in-depth analysis of the most recent relevant judgments of the CJEU.
Main issues of case law
- The sale of “second-hand” software since the CJEU decision in UsedSoft (C-128/11)
- Functionality of a computer programme: SAS Institute Inc v. World Programming Ltd (C-406/10)
- Recent case law on sui generis databases, including the CJEU Football Dataco case (C-173/11)
Key legal debates
- Copyright concepts revisited
- The adoption of Directive 2012/28/EU on orphan works
- Interface between copyright exceptions and the scope of licensing practices
- Multi-territorial licensing of rights in musical works for online use in the internal market (COM(2012)372)
- Licences for Europe and other key EU policy options including: cross-border access and the portability of services, user-generated content and licensing, print sector and cultural heritage institutions, confidentiality faced with electronic communications, whistleblowing and cloud computing.
