This seminar
will look at practical procedural aspects of interest for practitioners
involved in state aid matters and is aimed at Member State
representatives, lawyers representing recipients of State aid and their
competitors.
It will inter alia discuss the following matters:
- Procedural issues arising from administrative
proceedings before the Commission concerning State aid, such as the
right of interested parties to participate and be heard;
- Procedural aspects of judicial review
proceedings of different kinds of state aid decisions in the European
Courts and related difficulties;
- Enforcement of EU State aid law in national
judicial proceedings;
- Conditions governing the recovery of unlawful
or misused State aid and private enforcement of State aid rules, such as
actions by competitors for damages or injunctive measures;
- Minimum requirements on national remedies and
procedures set by EU law in enforcement actions in national court, such
as locus standi and evidence rules.
