Drafting Model Contractual Terms for Mandatory Data Sharing under the Data Act

Data Act requires in Article 41 that the European Commission shall, before 12
September 2025, develop and recommend non-binding model contractual terms on
data access and use. Christiane Wendehorst is a member of the expert group on
B2B data sharing and cloud computing contracts which assists the European
Commission in its work on developing model contractual clauses for B2B data
sharing and standard contractual clauses for cloud computing contracts. In this
e-presentation she gives an overview of contractual data sharing relationships
under the Data Act and explains the challenges to draft model contractual
clauses.
