On 19 January 2010, the European Commission published an external study on the quantification of antitrust damages on its website. In the White Paper on Damages Actions for Breach of the EC Antitrust Rules, published in April 2008, the European Commission pointed out that one of the obstacles to damages actions is the quantification of damages. In the White Paper, the Commission had set itself the objective to 'provide pragmatic, non-binding assistance in the difficult task of quantifying damages in antitrust cases, both for the benefit of national courts and the parties.' The study was prepared by Oxera and a multinational team of lawyers and is aimed at assisting the Commission in developing such guidance. The briefing will discuss how the guidance can help in addressing obstacles in the quantification of damages; through the provision of methods and models best suited to the availability and quality of data and information. The briefing will include contributions from a DG Competition official and a representative from a national judiciary directly involved in damages actions.
