Objective
Triggered by recent mass harm scandals with cross-border implications, notably Dieselgate, collective redress is back on the EU civil justice agenda.
In January 2020, negotiations on the new EU collective redress rules started between the Council and the European Parliament. The draft rules allow consumer organisations to seek remedy against trader violations in areas such as data protection, financial services, travel and tourism, energy, telecommunications, environment and health. The draft bill introduces the “loser pays principle” which is, like other issues, heavily debated.
This conference will:
- present the proposed EU Directive on representative actions for the protection of the collective interests of consumers
- provide a platform for debate on topical issues of this key Directive
- analyse major case law of the CJEU and national Supreme Courts on collective redress
- look at the mismatch of EU law and collective redress
- present most recent hands-on experience with collective redress
- debate funding issues, namely contingency fees and third-party funding.
