On 8 February 2012, the European Commission adopted a proposal for a Regulation on a European Foundation Statute, which now needs the approval of the Council of Ministers and the consent of the European Parliament.

The Statute would be an additional and optional European legal instrument allowing individuals and legal entities to set up a European Foundation (FE) according to the same conditions throughout the EU. It could help remove costly legal and administrative barriers that delay or hamper foundation-led European initiatives, thereby enhancing foundations’ ability to maximise their contribution to the public good at a time when the strings on government purses are tight.

The idea for a FE was identified as one of the concrete measures to support the objectives of the EU’s Single Market Act (Commission Communication, April 2011).

This briefing will present and discuss the Commission’s proposal and explore the way forward for the Statute.
