Topic

After explaining the motivations of producers and companies to protect their signs composed of geographical names through both trade mark registration and filing of a designation of origin, the e-presentation provides a critical analysis of the various possibilities offered by EU trade mark law for the protection of geographical names through the registration of individual, collective or certification marks. It also gives details of the current EUIPO practice and its consequences in practice.

Après avoir expliqué les raisons pour lesquelles les producteurs ou les entreprises détenant des signes comportant des noms géographiques souhaitent protéger leurs indications géographiques par le droit des marques, la présentation offre une analyse critique des différentes possibilités offertes pour le  dépôt de marques via marque individuelle, marque collective ou de certification en donnant des précisions sur la pratique actuelle de l’EUIPO et sur ses conséquences dans la pratique.

Benjamin Fontaine joined EGYP in Paris 1999 and has been an intellectual property attorney and a Spanish-qualified lawyer in the Alicante office since 2003. He became a partner of EGYP in June 2014. He has a broad range of experience in trade marks, appellations of origin and domain name piracy. He currently chairs ECTA’s Geographical Indications Committee.

Benjamin Fontaine a rejoint le cabinet d’avocats EGYP à Paris en 1999 en tant qu’agent en propriété intellectuelle, puis à partir de 2003, en tant qu’avocat inscrit au barreau d’Alicante. Il est devenu associé d’EGYP en Juin 2014. Il a une vaste expérience du droit des marques, des appellations d'origine et de la piraterie des noms de domaine. Il préside actuellement le Comité des indications géographiques de l'ECTA.
