Objective

From November 2016, the right in criminal proceedings to interpretation and translation, to information and to access to a lawyer must be guaranteed throughout almost all EU Member States thanks to the implementation of the respective EU Directives. Judges, prosecutors, defence lawyers, law enforcement officials as well as interpreters and translators will need to apply the new rights in their daily work.

  • When is there a need for interpretation? What are the essential documents? What remedies exist? Key issues of the right to interpretation and translation under Directive 2010/64/EU
  • When is the right time to hand out the letter of rights? What case material can be accessed? Key issues of the right to information under Directive 2012/13/EU
  • Police questioning in the presence of a lawyer? Obligatory legal aid?
  • Key issues of the right to access to a lawyer under Directive 2012/13/EU and of the right to legal aid
  • Main features of the Directives on presumption of innocence and procedural safeguards for children suspected or accused in criminal proceedings
  • Current definitions in the case law of the ECtHR
  • Getting started: the first case law of the CJEU, including I. Balogh (C-25/15) and G. Covaci (C-216/14)
  • Practical experiences from Estonia, Finland, Ireland, Latvia, Lithuania and Sweden

Important note

Seminar participation fee:
€150 including documentation, lunches and dinner.
Costs for travel and accommodation are reimbursed (see below).

The number of places available for participants is limited to 50 judges, prosecutors, defence lawyers, law enforcement officials and legal interpreters and translators from Estonia, Finland, Ireland, Latvia, Lithuania or Sweden. Participation upon selection!   

Travel and accommodation:
Travel costs up to €300 (including taxi costs) and two nights' hotel accommodation up to 80€/night will be reimbursed by ERA upon receipt of the original receipts, tickets, boarding passes, invoices after the seminar. Participants are asked to book their own travel and accommodation.

These rules do not apply to representatives of EU Institutions and Agencies who should cover their own travel and accommodation.

Spanish applicants who work for the prosecution service (CEJ) must apply for this event through CEJ.

Who should attend?

Judges, prosecutors, defence lawyers, law enforcement officials and legal interpreters and translators mainly from Estonia, Finland, Ireland, Latvia, Lithuania and Sweden.
