Objective

The seminar aims to create a forum where national judges can discuss, express their views and exchange their experiences on various aspects of proceedings related to telecommunications and electronic communications law. Different panels will analyse challenging issues, trying to identify and share best practice among judiciaries. Speakers from different national courts will present the topics and lead the debate.

Key topics

  • Ex ante v. ex post regulation: are there markets where competition is becoming sufficiently effective to give way to a normal competition law approach?
  • The standard of review to be applied to the situations envisaged in Article 4 of the Framework Directive
  • How national courts deal with: (i) the use of confidential documents, (ii) independent experts
  • Admitting evidence not considered in the national regulatory authority decision
  • Handling appeals from alternative dispute resolution decisions
  • Managing large files and complex proceedings: what can be learned from the experiences in different Member States
  • Relationship between European law and national law
  • The Connected Continent legislative package

Registration

Open to members of national courts dealing with telecommunications cases.
