In a landmark ruling on 4 October 2011 (C-403/08 and C-429/08, Football Association Premier League and others V QC Leisure and Others and Karen Murphy V Media Protection Services Ltd), the European Court of Justice stated that a system of licences for the broadcasting of football matches which grants broadcasters territorial exclusivity on a Member State basis and which prohibits television viewers from watching the broadcasts with a decoder card in other Member States is contrary to EU law. The main legal aspects of this judgment concern free movement of services, competition law and copyright-protected works.
This ERA briefing will present the judgment’s most important aspects and discuss them in the light of their crucial legal and commercial implications for holders and acquirers of copyright and for consumers.
