Objective

Since May 2017, EU Member States (except Ireland and Denmark) must have legislation in force to apply the European Investigation Order (EIO) in criminal matters covering all types of evidence.

This seminar will offer practical training on the application of the EIO for central authorities, judges, prosecutors, law enforcement officials as well as defence lawyers providing a platform for discussion across professions and EU Member States. At the same time, in-depth training will be offered to the individual professions by means of separate workshops. While judges, prosecutors and law enforcement officials will take a detailed look at the conditions for issuing and executing EIOs, defence lawyers will look at the rights of the defence in this regard.  

Special focus will be given to the procedures and first experiences with the gathering of evidence and execution of EIOs in in Croatia, the Czech Republic, Greece, and Spain.

  • The relation between the EIO and similar instruments such as the European Evidence Warrant, the 2000 MLA Convention, Joint Investigation Teams and their different application
  • Proportionate, adequate, and applicable: scope and content of the EIO
  • Conditions for issuing an EIO, channels for transmission, and the possibility to request the issuing of an EIO
  • Investigative measures under the EIO and national exemptions
  • Conditions for executing an EIO and grounds for refusal

Who should attend?

Competent authorities to issue and execute EIOs as defined by the Member States (central authorities, judges, prosecutors, law enforcement officials) as well as defence lawyers interested in learning about the EIO implementation in Croatia, the Czech Republic, Greece, and Spain.

Participation conditions

The number of places available for participants is limited and subject to an application procedure. 

Spanish applicants who work for the prosecution service (CEJ) must apply for this event through CEJ.

Seminar participation fee:
€150 including documentation, lunches and dinner.

Travel and accommodation:
Travel costs up to €300 and two nights' hotel accommodation up to 130€/night (24-26 October 2018) will be reimbursed by ERA upon receipt of the original receipts, tickets, boarding passes, invoices after the seminar. Participants are asked to book their own travel and accommodation.

These rules do not apply to representatives of EU Institutions and Agencies who should cover their own travel and accommodation.

Please note that due to the large number of applications for this series on European Investigation Order, participants can register only for 1 event (at their choice) out of the 4 contemplated here.
