The European Commission has adopted a new Regulation block-exempting certain types of agreements in the insurance sector from the EU‘s general prohibition of practices restrictive of competition. The new regime, which came into force on 1 April, renews - with some amendments - two of the four categories of agreements previously exempted, namely joint compilation, tables and studies, and co(re)insurance pools.
Certain information exchange can be justified in order to allow insurers to assess risks accurately. Pooling is also important in order to ensure that all risks can be covered. These two types of agreement justify a block exemption.
The aim of the briefing is to discuss all the issues above with a European Commission official involved in the drafting of the new regime and a private practitioner with experience in the application of this specific block exemption regime.
