A self-standing training module on ‘Cross-border parental responsibility, including child abduction' is being developed, which will be published and made available to all judicial actors on the European e-justice Portal.
The
objectives of this workshop, aimed at judicial trainers, are:
to “test” and raise awareness of the training module on ‘Cross-border parental responsibility, including child abduction’
- to familiarise participating judicial trainers with the structure and content of the training module
- to provide a framework for the organisation of further training events in the area of EU Family Law
- to consolidate available legal texts and e-justice tools in the area of EU Family Law
- to foster dialogue between judicial trainers of different national backgrounds
- to promote contacts between judicial trainers at EU level
The training material presented during the workshop will cover the EU acquis on the following topics:
- Cross-border parental responsibility – jurisdiction, applicable
law, provisional measures, recognition and enforcement of the judgment
- Cross-border child abduction within the EU
- Procedure in family matters – hearing of the child, cross-border communication between courts or between central authorities
- References for a preliminary ruling in family matters
Further to EU legislation, practice and jurisprudence, the module will include a
national section from each EU Member State illustrating the application and implementation of EU Family Law at national level. An
e-learning course providing a basic introduction into the subject matter, a
users’ pack with all related legal texts and a
trainer’s pack
including background material and a trainer’s manual that will assist
future trainers to best make use of the module will as well be
contained. These materials will be presented in detail during the
workshop, so that their function and possible integration in further
training programmes is effectively explained.
The
various training methods
that may be used in future training events in the area of EU Family Law
will also be illustrated and recommendations on how to best employ them
provided. Face-to-face presentations can be combined with practical
exercises requiring the active contribution of the participants.
IT-supported training, allowing participants the opportunity to
familiarise themselves with the e-justice tools available can be used
and interactive sessions promoting the exchange of good practices and
experience may be included in a training programme. The various
advantages and disadvantages of the different options available and
ideas on which method may be most appropriate for the different topics
will be discussed during the workshop
This workshop is a project of
the European Commission
in the framework of the development of training modules regarding
European legislative instruments for cross-border cooperation in civil
matters, which is implemented by
the Academy of European Law (ERA) and with the support of
the Belgian Judicial Training Institute (IFJ).
The whole project is implemented in partnership with the Austrian
Federal Ministry for Justice, the Czech Judicial Academy, the Finnish
Ministry of Justice, the German Federal Ministry of Justice, The Latvian
Judicial Training Centre, the Polish National School of Judiciary and
Public Prosecution, The Romanian Superior Council of the Magistracy and
the Slovenia Judicial Training Centre.
No workshop fee. Participation on selection. Selected participants will
receive a significant contribution to their travel and accommodation
costs.
