Objective
This year’s conference will provide family lawyers with an analysis of Regulation (EU) 1259/2010 which will apply from 21 June 2012. This so-called “Rome III” Regulation allows international couples to know in advance which law would apply to their divorce.
Member States participating in this first enhanced cooperation include Austria, Belgium, Bulgaria, France, Germany, Hungary, Italy, Latvia, Luxembourg, Malta, Portugal, Romania, Slovenia and Spain. In June 2012, Lithuania announced its decision to join this enhanced cooperation.
Recent case law on the Brussels IIbis Regulation and the related Hague Conventions will also be discussed. Finally, the conference will present the legislative initiatives on property rights of international couples as well as the recently adopted Regulation on cross-border successions.
